Lawsuit Filed Against Verizon for Wiretapping - The Associated Press

"An attorney and entrepreneur has filed a lawsuit against Verizon Communications Inc. alleging it has illegally collaborated with the National Security Agency's wiretapping operations. The suit by Michael Pascazi of Fishkill, N.Y., seeks to represent millions of Verizon customers in a class action. It seeks $20 billion in damages for alleged violations of customer privacy by a warrantless government wiretapping program.

Randal Milch, Verizon's senior vice president of legal and external affairs, called the lawsuit 'completely without merit.' The suit was filed in U.S. District Court in New York."


Hmmm... a page from the Brown and Goldman (c.f. OJ Simpson wrongful death suit) book of legal action: If you can't get them under criminal or administrative law, go for broke in civil court. Breach of privacy suits involving disclosure of communication have been successfully brought against telecommunications providers under the Electronic Communications Privacy Act of 1986 and precedents do exist. However, I doubt that this case will have a chance given the Republican/ultra-conservative stacked federal bench where government and big business gets a better deal than the average citizen. This is especially true given that Verizon will probably claim that cooperating with the NSA was a duty and legal obligation, especially if a subpoena was issued. However, if Google is successful in defeating the DOJ subpoena for its records, that may give this case some punch. If several pending EFF, EPIC and ACLU suits are successful, then even more punch can be packed. It could help if there were various amicus briefs filed as well. I am thinking about sending him some money to help with the suit just to see it played out and assess whether the "little guy" can take on the corporate and government giants with any possibility of justice.
